1. Who we are

This website is operated by Thistle Bakery (PTY) Ltd (“Thistle Bakery”, “we”, “us”, “our”), a company registered in South Africa. Our bakery and factory shop are at 15 Brussels Road, Aeroport, Spartan, Kempton Park, Gauteng, 1619. 2. These terms

These terms apply to every order you place with us through this website. By placing an order you confirm that you accept them. Please read them before you order. If there is anything you do not agree with or do not understand, contact us before placing your order.

3. Placing an order

All orders require a minimum of 48 hours’ notice so that your items can be freshly baked. Orders placed with less notice may not be accepted.

When you complete checkout you will receive an email acknowledging your order. That acknowledgement confirms we have received the order, but it is not acceptance of it. A contract between us comes into existence only once we confirm that we are able to bake and fulfil your order.

We may decline an order where an item is unavailable, where the lead time cannot be met, where there is an error in the price or description of an item, or where we are unable to verify payment.

4. Prices and payment

All prices are shown in South African Rand (ZAR). Prices may change from time to time, but changes will not affect an order we have already confirmed.

We accept the payment methods offered at checkout. Where payment is made by electronic funds transfer, your order is only confirmed once the funds reflect in our account. Where you elect to pay on collection, payment is due in full before the order is handed over.

We take reasonable care to ensure that prices and product information on this site are correct. If we discover an error in the price of items you have ordered, we will contact you to confirm whether you wish to proceed at the corrected price or cancel the order.

5. Collection only

We do not deliver. All orders are collected from our factory shop at 15 Brussels Road, Aeroport, Spartan, Kempton Park.

Collection hours are Monday to Friday 06h30–16h30 and Saturday 07h00–13h00. We are closed on Sundays and public holidays unless we advertise otherwise. Please collect your order within our trading hours on the agreed date.

Because our products are freshly baked and perishable, orders that are not collected on the agreed date may not be able to be held. Please see our Refund and Collection Policy for what happens in that case.

6. Our products

Everything we sell is handmade. Small variations in size, colour, decoration and finish are a normal part of handcrafted baking, and photographs on this site are intended as a guide rather than an exact representation of the item you will receive.

Product availability can vary seasonally. Some items are baked to order only.

7. Allergens

Our products are made in a bakery that handles wheat and gluten, eggs, dairy, soya, nuts and seeds. We cannot guarantee that any product is free from traces of these allergens, as the same equipment and premises are used across our range.

If you or anyone you are ordering for has a food allergy or intolerance, please contact us before ordering so we can tell you what is in a particular product. Do not rely on the product description alone.

8. Custom and celebration orders

Custom cakes, cupcakes and decorated items are quoted individually. Custom orders require longer lead times than 48 hours, which we will confirm when we quote.

We may require a deposit before we begin work on a custom order. Because these items are made specifically to your design and cannot be resold, deposits on custom orders are not refundable once baking or decorating has started. Please see our Refund and Collection Policy.

Where you supply artwork, images, logos or text for us to reproduce on a product, you confirm that you have the right to use them and that doing so does not infringe anyone else’s rights.

9. Wholesale orders

Wholesale lines are supplied on quotation and are not priced on this website. Volumes, lead times, pricing and payment terms for wholesale supply are agreed separately and are not governed by the online checkout process.

10. Cancellations and refunds

Your rights to cancel an order and to a refund are set out in our Refund and Collection Policy, which forms part of these terms.

11. Our responsibility to you

Nothing in these terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be limited or excluded.

Subject to that, we are not liable for losses that were not reasonably foreseeable at the time you placed your order, or for losses arising because you did not tell us about a relevant allergy, dietary requirement or event date.

12. Your personal information

We handle your personal information in line with our Privacy Policy, which explains what we collect, why we collect it, and what your rights are.

13. Changes to these terms

We may update these terms from time to time. The version published on this page at the time you place your order is the version that applies to that order.

14. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute arising from them.
